Právní a ekonomické aspekty označování alergenů v potravinách a pokrmech

Abstract

Téma diplomové práce je Právní a ekonomické aspekty označování alergenů v potravinách a pokrmech. Cílem práce je tedy objasnění nejdůležitějších pojmů a zhodnocení přínosu právních norem, které podnikatelům ukládají povinnost označovat alergeny ve svých produktech. Toto téma je ještě stále aktuální a plné otázek díky novelám, které vstoupily v platnost začátkem roku 2015. Problematika označování alergenů je zde pojímána jak z právního, tak z ekonomického hlediska. Právní stránka věci popisuje především prameny a normy, které problematiku upravují. Ekonomická část posuzuje označování alergenů u potravin a pokrmů z hlediska nákladů. Účinnost a efektivnost zavedení označování alergenů je zkoumána z pohledu spotřebitele, tedy běžného návštěvníka stravovacího zařízení i z pohledu podnikatele nebo provozovatele a to pomocí dvou dotazníkových šetření. Zkoumány jsou výhody i nevýhody, které z toho pro obě strany plynou. První dotazník se zaměřuje na spotřebitele a zjišťuje jeho obeznámenost a případně spokojenost s přístupem k informacím o alergenech v potravinách. Druhý dotazník se ptá podnikatele především na jeho pojetí označování alergenů a případné nástrahy, které jsou s aplikací označování spojeny. Oba dotazníky pomáhají odpovědět na otázku, zda je označování alergenů u potravin ve své současné podobě dostačující a splňuje účel ke kterému bylo zavedeno. Dále se práce zabývá kontrolou ze strany příslušných orgánů dohlížejících na označování alergenů v praxi. Výsledky diplomové práce by mohly napomoci k dokonalému pochopení problematiky označování alergenů ze strany podnikatelů a provozovatelů stravovacích zařízení.

The name of this diploma thesis is Legal and Economic Aspects of the Labeling of Allergens in Foods and Meals. The aim of the thesis is to explain the most important terms and evaluate a contribution of legal norms, by which the entrepreneurs are obliged to label allergens in their products. This topic is still topical and full of questions thank to the amendments coming into force at the beginning of 2015. The topic of labeling of allergens is discussed from both legal and economic views. Legal part describes mainly the sources and norms, by which the labeling is issued. Economic part sees the topic in terms of the costs. Effectiveness of allergens labeling is investigated from the side of consumer thus common visitor of eating facility as well as from the side of entrepreneur or runner; the questionnaires were used to fulfill the aim of diploma thesis. Advantages and disadvantages are considered. The first questionnaire is focused on the consumers and tries to find out their awareness or satisfaction with the access to information about allergens in food. The second questionnaire investigates the entrepreneur´s understanding of the issue and possible danger connected with labeling application. Both questionnaires help to answer the question whether the allergens labeling by food is suitable in its present shape and whether it fulfills the purpose, for which it was implemented. The thesis further deals with the control of relevant authorities, which supervise the labeling of allergens in practice. Conclusions mentioned in this thesis could help the entrepreneurs and runners of eating facilities to understand the topic.
