Ochrana hospodářské soutěže

Abstract

Cílem této práce je definovat problematiku hospodářské soutěže, vysvětlit rozdíly mezi dvěmi stěžejními oblastmi soutěžního práva a analyzovat právní prostředky ochrany proti nekalé soutěži. Práce je členěna do šesti kapitol, z nichž první seznamuje nejen se základními pojmy, ale také s Úřadem pro ochranu hospodářské soutěže, soutěží v kontextu s Evropskou unií a právem hospodářské soutěže. Kapitola druhá je zaměřena na skutkové podstaty nekalé soutěže, kapitola třetí pak na skutkové podstaty nedovoleného omezování hospodářské soutěže. Rozdíly mezi nimi a konkrétní příklady uvádí kapitola čtvrtá. Pokud jde o kapitolu pátou, ta je analýzou soukromoprávních, veřejnoprávních a mimoprávních prostředků ochrany proti nekalé soutěži. Poslední kapitola je celkovým zhodnocením problematiky hospodářské soutěže.

The aim of this study is to define dilemma of the economic competition, to explain differences among two primary spheres of the competition law and to analyse the legal remedies of protection against unfair competition. This study work is structured into six chapters when first of them acquaints not only with the basic terms, but also with the Bureau for protection of competition, with the competition in context with the European Union and with the competition law. The second chapter is focused on merits of the unfair competition and the third chapter is aimed on merits of the prohibited restrictions of economic competition. The differences among them and their concrete examples describes the chapter four. In the matter of the chapter five, this is the analyse of legal remedies of protection against unfair competition. The final chapter is a global summary of this dilemma of the economic competition.
