Právní aspekty změn zemského povrchu na území ovlivněných hornickou činností z pohledu KN

Abstract

Záměrem této práce je mimo jiné posoudit vliv hlubinné těžby na věcná práva evidovaná v katastru nemovitostí, a to především ovlivnění práva vlastnického, věcného břemene a práva zástavního, včetně vlivu na stav zápisu v katastru nemovitostí v oblastech dotčených hlubinnou těžbou. Práce se dále zabývá možnostmi nápravy katastrální mapy v katastrálních územích dotčených hlubinnou těžbou, vyhodnocuje jednotlivé stávající možnosti nápravy, tedy nové mapování, přepracování či revizi katastru. Částečně je zde rovněž zmíněn postup při mapování v sousedním Německu, jakož i systém zjišťování náhrady škody vzniklých hlubinnou důlní činností v Polsku. Cílem této disertační práce je rovněž dosáhnout novelizace vyhlášky č. 357/2013 Sb., katastrální vyhláška, a to konkrétně jejího § 95, což je během tvorby této práce skutečně povedlo. Díky této novelizace se otevřela cesta pro nápravu katastrální mapy formou revizí katastru, u nich nad běžný rámec dojde k zaměření identických bodů a následné transformaci. Výsledek této práce je tedy nalezení použitelné metody k nápravě katastrálních map v územích ovlivněných hlubinnou těžbou, k čemuž přispívá velmi významně dosažení novelizace shora citovaného ust. § 95 katastrální vyhlášky. Tato práce je svým charakterem převážně empirická, že založena na získání reálných dat, měření v terénu, reálné provádění výpočtů a transformací, s cílem dosáhnout výsledku použitelného v praxi katastrálních úřadů.

The purpose of this work is, among other things, to assess the effect of deep mining on property rights registered in the real estate cadastre, and above all the impact on the right of ownership, encumbrance and lien rights, including the effect on the status of registration in the real estate cadastre in the areas affected by deep mining. The work also deals with the possibilities of correcting the cadastral map in the cadastral territories affected by deep mining, it evaluates the individual existing possibilities of correction, i.e. new mapping, renewal or revision of the cadastre. The mapping procedure in neighboring Germany is also partially mentioned here, as well as the system for determining compensation for damage caused by underground mining activities in Poland. The aim of this dissertation is also to achieve the amendment of Decree No. 357/2013 Coll., the cadastral decree, specifically its § 95, which actually succeeded during the creation of this thesis. Thanks to this amendment, the way has been opened for the correction of the cadastral map in the form of cadastral revisions, where control points will be targeted beyond the normal framework and then transformed. The result of this work is therefore the finding of a usable method for correcting cadastral maps in areas affected by deep mining, to which the achievement of the above-mentioned amendment of § 95 of the cadastral decree contributes very significantly. This work is mainly empirical in nature, based on the acquisition of real data, measurements in the field, real implementation of calculations and transformations, with the aim of achieving a result applicable in the practice of cadastral offices.
