Dopad oznamování a ochrany oznamovatelů v České republice a ve vybraných zemích světa na korupci ve veřejné správě

Abstract

Předložená diplomová práce se zaměřuje na dopad oznamování a na důsledky ochrany oznamovatelů v České republice a ve vybraných zemích světa v souvislosti s korupcí ve veřejné správě. Korupce se ve 21. století stala jedním z nejpoužívanějších pojmů a zároveň je považována za jeden z největších problémů na světě. Ochrana oznamovatelů neboli whistleblowing patří mezi nejúčinnější nástroje v boji proti korupci. Česká republika patří k zemím v Evropské unii, které zatím stále nepřijaly komplexní zákon, jenž by se věnoval ochraně oznamovatelů. Cílem této diplomové práce je zhodnocení vlivu právní úpravy whistleblowingu na míru korupce ve vybraných zemích světa. Teoretická část práce se zabývá charakteristikou pojmů korupce a whistleblowing (společně s historií jeho vzniku), dále osvětluje dělení na interní a dva externí mechanismy whistleblowingu. Další kapitola je věnována aktuální právní úpravě České republiky, která poskytuje částečnou ochranu oznamovatelům. Dále jsou uvedeny nevládní neziskové a mezinárodní organizace, které svou činností přispívají k osvětě whistleblowingu a ochraně oznamovatelů, a to jak svou publikační činností, tak organizací konferencí a právní ochranou. Nezastupitelnou roli zastávají média, která dokážou v některých případech pozvednout příběh oznamovatele a napomoci k jeho došetření, nebo jej také mohou upozadit. Práce se zaměřuje i na čtyři legislativní návrhy na ochranu oznamovatelů, které byly doposud předloženy vládě, ale ani jeden z nich neprošel schválením. Část práce je věnována zhodnocení právních úprav na vliv míry korupce ve vybraných zemích, resp. komparaci a analýzy právních úprav v daných zemích. Závěr práce se soustředí na postoj Evropské unie a aktuální vývoj právních úprav v rámci jejích členských zemí.

The submitted thesis focuses on the impact of whistleblowing and protection of whistleblowers in the Czech Republic and in selected countries of the world on corruption in public administration. Corruption has become one of the most widely used concepts in the 21st century and is considered one of the greatest problems in the world. Whistleblowing is one of the most effective tools in the fight against corruption. The Czech Republic is one of the countries in the European Union that has not yet adopted a comprehensive law to protect whistleblowers. The aim of this thesis is to evaluate the influence of the legal regulation of whistleblowing on the level of corruption in selected countries of the world. The theoretical part deals with the characteristics of the concepts of corruption and whistleblowing (together with the history of its origin), it also explains the division into internal and two external mechanisms of whistleblowing. The next chapter is devoted to the current legislation of the Czech Republic, which provides partial protection to whistleblowers. In addition, non-governmental, non-profit organizations and international organizations that promote whistleblowing and whistleblower protection by publishing, conferencing and legal protection are listed. Media play an irreplaceable role, or in some cases, can lift the whistleblower story and help investigate it, or they can also delay it. The work also focuses on four legislative proposals to protect whistleblowers that have been submitted to the government so far, but neither of them has passed the approval. Part of the work is devoted to the evaluation of legal adjustments to the impact of corruption in selected countries, respectively. comparing and analyzing legal regulations in the countries concerned. The conclusion of the thesis focuses on the position of the European Union and the current development of legislation within its member countries.
