Analysis of GDPR Application in IT Companies in the Czech Republic

Abstract

It has been almost two years since the General Data Protection Regulation (GDPR) came into force. Since then, there were not conduct many pieces of research about successfulness its application. Therefore, this dissertation investigated how companies in the selected field of business, thus IT companies headquartered or having a branch in the Czech Republic, evaluate the GDPR from the perspective of two years of its effectiveness, whether it was or was not difficult to become compliant with the GDPR, what measures did they had to implement, etc. Based on the review of the literature, the main six areas of research focus were identified. These areas represent activities or other obligations resulting from the GDPR, with which companies had to deal with it. The qualitative approach of the research was chosen to obtain appropriate data. Using the interview as a research method, five representatives of IT companies from Czech Republic were interviewed via online meeting. Based on finding from the six areas of the research, the main research questions were answered. The result indicated that companies are compliant with the GDPR, and therefore it refuted the expectation that they would not be, which was based on the literature review. Findings from the research can be used as a guide for improvements in other IT companies headquartered or having a branch in the Czech Republic. In the same time, further detailed research focused on one of the six identified areas can be conducted.

Ode dne, kdy Obecné nařízení o ochraně osobních údajů (GDPR) vešlo v platnost, uplynuly téměř dva roky. Od té doby nebylo provedeno mnoho výzkumů o úsěšnosti aplikace tohoto nařízení. Cílem této bakalářské práce bylo tedy zjistit, jak si společnosti ve vybraném oboru podnikání, tedy IT společnosti sídlící nebo mající pobočku na území České republiky, vedly při aplikaci GDPR, zda bylo obtížné najít cestu k souladu s GDPR, jak jej s odstupem času hodnotí, jaká opatření museli zavést, atd. Pomocí přezkumu dostupné literatury bylo identifikováno šest hlavních oblastí zaměření výzkumu. Tyto oblasti představují činnosti nebo povinnosti vyplívající z GDPR, s nimiž se společnosti musely vypořádat. Aby byla získána vhodná data pro výzkum, byl zvolen kvalitaivní přístup k výzkumu. Pomocí rozhovorů, které byly vybrány za výzkumnou metodu, bylo provedeno celkem pět online rozhovorů se zástupci IT společností z České Republiky. Na základě výsledků z šesti hlavních oblastí výzkumu byly zodpovězeny všechny výzkumné otázky. Výsledky odhalily, že společnosti jsou v souladu s GDPR a tím byla vyvrácena mylná doměnka o nesouladu, která byla založena na přezkumu literatury. Výsledky z výzkumu mohou využít jak dotazované, tak všechny ostatní IT společnosti, sídlící nebo mající pobočku na území České republiky, jako návod pro hledání slabých stránek ve vlastní aplikaci GDPR. Výsledky z jednotlivých šesti oblastí výzkumu mohou být také využity jako základ pro další výzkum.
