Regulace vinařství a dopady změn

Abstract

Diplomová práce se věnuje zachycení aktuální podoby tzv. vinařského zákona a dopadů, které vyvolala jeho změna. Cílem práce je popsat a zhodnotit změnu v právní úpravě zákona č. 321/2004 Sb., o vinohradnictví a vinařství, ve znění pozdějších předpisů, a zjistit její dopady na vinařský průmysl, zejména na subjekty v něm podnikající a jejich praxi. Dílčím cílem práce je zhodnotit aktuální podobu předpisů v problematice balení vína a důsledky vyvolané zmíněnou legislativní změnou v této oblasti. Práce se z oblasti vinařského průmyslu věnuje především vinařství, velmi okrajově související zákonné úpravě vinohradnictví a Vinařského fondu. V teoretické části práce je představena problematika vinařství z praktického a legislativního pohledu. V praktické části se rozebírají jednotlivé změny a jejich dopady na jednotlivé dotčené subjekty za pomoci rozboru dostupných dat a dotazníkového šetření.

The diploma thesis is focused on capturing the current form of the so-called wine law and the impacts caused by its change. The aim of this work is to describe and evaluate the change in the legislation Act No. 321/2004 Coll., on viticulture and wine making, as amended, and to determine its impact on the wine industry, especially on subjects doing business in it and their practice. The partial goal of the thesis is to evaluate the current form of regulations in the field of wine packaging and the consequences caused by the legislative change in this area. In the field of the wine industry, the work focuses mainly on viticulture, a very marginally related legal regulation of wine making and the Wine Fund. The theoretical part of the thesis presents the issue of viticulture from a practical and legislative point of view. The practical part discusses the individual changes and their impacts on the various subjects with the help of analysis of available data and a questionnaire survey
