Problematika úpadku z právního a ekonomického hlediska

Abstract

Tato bakalářská práce je zaměřena na problematiku úpadku z hlediska právního a ekonomického. Cílem práce je rozebrat úpadek, posoudit úpadkové trestné činy a vymezit možnosti prevence úpadku. Práce je rozdělena do dvou částí, teoretické a praktické. V teoretické části práce je vymezen pojem úpadek a jsou představeny jeho právní i ekonomické příčiny a důsledky. Metodou deskripce jsou popsány úpadkové delikty. V praktické části práci jsou analyzovány dva příklady z praxe, kterými se zabýval Nejvyšší soud ČR. V další části práce jsou také diskutovány možnosti prevence úpadku a hospodářské kriminality. V závěru práce jsou shrnuty závěry a poznatky z teoretické i praktické části práce, jakož i možnosti prevence úpadku a s ním spojených trestných činů.

This bachelor thesis is focused on the issue of bankruptcy from legal and economic point of view. The aim of the thesis is to discuss the bankruptcy, assess the bankruptcy crimes and determine certain options of bankruptcy prevention. In theoretical part of the thesis, there is the concept bankruptcy determined and its legal and economic reasons and consequences are presented. Bankruptcy crimes are described by description method. The practical part of the thesis discusses two cases of the practice, which were dealt with by the Supreme Court of the Czech Republic. In the following part of the thesis, options of bankruptcy and bankruptcy crimes prevention are dealt with. In the conclusion, there are results and knowledge of theoretical and practical parts of the thesis summarized as well as options of prevention of bankruptcy and crimes related to it are presented.
