Vývoj umelej inteligencie ako výzva právu

Abstract

Bakalárska práca je zameraná na aktuálny vývoj právnej úpravy regulujúcej umelú inteligenciu. Cieľom práce je zistiť, do akej miery miestne firmy vnímajú potrebnosť zavedenia záväznej právnej regulácie UI a špecifikovať spôsoby, akými by sa táto právna regulácia mohla uberať. V teoretickej časti sú ako prvé vymedzené nezáväzné definície UI a jej delenie. Následne sa teoretická časť zameriava na minulé pokusy o právnu úpravu UI, vymedzenie pojmu soft law, snahu Európskej únie o reguláciu UI hlavne prostredníctvom aktuálne prejednávaného nariadenia EU AI Act, problematiku diskriminácie zo strany UI a potenciálne zmeny, ktoré by UI mohla priniesť do oblasti medzinárodného a autorského práva. V praktickej časti je uvedená základná charakteristika firmy, s ktorou som spolupracovala. Následne sú popísané a analyzované jednotlivé odpovede tejto firmy, ktoré boli poskytnuté v rámci dotazníkového šetrenia. Nato bola prevedená komparácia výsledkov tohto dotazovania s mnou prevedeným prieskumom, ktorý sa skladá zo skúmania zahraničných impulzov v oblasti využívania a regulácie UI. Ako výsledok bola overená hypotéza nejasnosti pojmu UI v miestnych firmách a súvisiaci nedostatočný záujem o témy spojeného s jej právnou úpravou. Na základe zistení boli stanovené sociálne, legislatívne a ekonomické výhľady UI v ČR do budúcna.

This bachelor thesis is focused on current development of legislation regulating artificial intelligence. The aim of the thesis is to find out, in which range companies feel a need for binding legislation regulating artificial intelligence and to specify ways how this legislation could be reached. In theoretical part non-binding definitions of AI and its division are defined. Subsequently, it is focused on past attempts to regulate AI, definition of soft law and ongoing efforts of EU within this topic are described mainly through EU AI Act. It also deals with topics of discrimination and possible changes in international and copyright law. Practical part involves the basic characteristics of concrete entrepreneur. Subsequently, the individual answers of this company, which were provided as a part of the questionnaire survey, are described and analyzed. The results of this survey were then compared with the survey of foreign impulses in the field of usage and regulation of AI. As a result, the hypothesis of the misunderstanding the concept of AI in local companies and related lack of interest in its legal regulation were verified. Based on the results, the social, legislative and economic prospects for the future of AI in the Czech Republic were determined.
