Právní a ekonomické základy autorských organizací a jejich vztah k masmédiím

Abstract

Právní a ekonomické základy autorských organizací a jejich vztah k massmédiím Tato práce si klade za cíl komplexně vyložit problematiku kolektivní správy autorských práv v České republice, a to zvláště u organizací, které se zabývají autorskými právy hudebníků a textařů, tedy OSA a Intergram a objasnit princip rozúčtování autorských odměn. V první části se zabývám vznikem autorského práva, jeho historií a vývojem. Dále jsem rozebírala právní východiska ochrany autorských práv v ČR. Cílem mé práce nebyl úplný opis autorského zákona a příslušných dokumentů, ale pouze ta částí, která je podstatná pro mou práci. Druhá část práce se věnuje ochranným organizacím, které se zabývají kolektivní správou autorských práv. Z těch mezinárodních jsem vybrala jen ty, které spolupracují s OSA a Intergram. Hlavním bodem této části ale bylo popsat fungování, strukturu, historii a hospodaření OSA a Intergram. V třetí části se věnuji vyúčtování autorských poplatků a rozúčtování autorských odměn.

Legal and economic foundations of copyright organizations and their relationship to mass media This work aims to interpret the complex issues of collective management of copyright in the Czech Republic, especially in organizations dealing with copyrighted musicians and songwriters, it means OSA and Intergram, and explain the principle of distribution of royalties. The first part deals with the creation of copyright law, its history and development. Furthermore, I analysed the legal basis of copyright protection in the country. The aim of my work was not a complete description of copyright law and the relevant documents, but only the part that is essential for my work. The sekond part is devoted to protection organizations that deal with collective management of copyrights. Of those, I selected only the international ones that interact with OSA and Intergram. The main point of this part, was to describe the functioning, structure, history and management of OSA and Intergram. The third part is focus on the accounting and distribution of royalties.
