Směnárenství z pohledu ochrany spotřebitele a zájmů státu

Abstract

Bakalářská práce si v úvodu stanovuje za svůj cíl určit, zdali je české směnárenství po dvou dekádách vývoje stále rizikem pro stát a své klienty, nebo zdali je neblahá pověst již jen pozůstatkem minulosti. Pro dosažení cíle je směnárenství zasazeno do širšího historického kontextu s důrazem na vývoj devizového práva. Celá jedna kapitola je pak věnována současným právním předpisům upravující směnárenskou činnost. Hlavní těžiště práce pak tkví v prozkoumání problematiky ochrany spotřebitele směnárenských obchodů jak ze strany teoretické, tak praktické. Nejdříve je popsán legislativní rámec ochrany spotřebitele a z nich vyplývající povinnosti pro směnárny, následně je na základě průzkumu směnáren v terénu zjištěno, jaká je reálná úroveň dodržování těchto právních předpisů. Ve své druhé polovině se práce zabývá povinnostmi směnáren v boji proti praní špinavých peněz. Zde je letmo vzpomenuto na problematiku nelegálních směn za dob socialistického uspořádání a poukázáno na zcela nové výzvy, se kterými se musí vyrovnávat dnešní společnost. Současný stav je zde pak rozebírán z pohledu vymahatelnost právních předpisů a úrovně plnění kontrolní povinnosti ze strany pověřených orgánů.

My Bachelor thesis, at the beginning, puts down the question whether the Czech foreign exchange is after two decades of development still hazard for state and also for its clients and whether the disrepute is only the remainder of history. To achieve the aim the foreign exchange is put into wider historical context with emphasis on development of foreign exchange law. One whole chapter is devoted to contemporary legislation editing the exchange activity. The core of my work is in exploring the issue of consumer protection of current exchange trade from both theoretical and practical point of view. At first there is described the legislative part of law protecting consumers and the ensuing responsibilities of exchange offices, then on the basis of field survey the quality of compliance of money changers was found. The paper, in its second part, deals with the duties of money changers in the fight against money laundering. Here is briefly remembered the issue of illegal exchange in the times of the socialist organization and pointed to an entirely new challenges that have to deal with today's society. Current situation is then analyzed from the perspective of the law enforcement and the level of performance of monitoring duties of the responsible authorities.
