Neoprávněné podnikání z právního a ekonomického hlediska

Abstract

Cílem mé diplomové práce je vymezit neoprávněné podnikání, jeho ekonomické a právní příčiny, dále popsat důsledky neoprávněného podnikání, nastínit trestně právní úpravu neoprávněného podnikání a na závěr navrhnout opatření vedoucí k omezování tohoto jevu. Neoprávněným podnikáním se ve své diplomové práci zabývám jak z hlediska teoretického (popis jednotlivých zákonů upravující tento pojem) tak z hlediska praktického (popis případů z praxe, srovnání statistik). V první kapitole definuji podnikání, neoprávněné podnikání z hlediska živnostenského a trestního a možné příčiny neoprávněného podnikání. V druhé kapitole jsem se zabývala důsledky neoprávněného podnikání a vyčíslila škody způsobené hospodářskou trestnou činností a neoprávněným podnikáním. V třetí kapitole provádím rozbor neoprávněného podnikání z hlediska trestního práva z pohledu předešlé úpravy § 118 trestního zákona z roku 1961 a nové úpravy § 251 trestního zákoníku z roku 2009. Na závěr uvádím soudní a policejní statistiky zjištěných případů neoprávněného podnikání. V poslední části se zabývám možnými preventivními opatřeními vedoucím k omezování neoprávněného podnikání.

The aim of my diploma work is to define the unauthorized business and its economic and legal causes and to describe consequences of the unauthorized business. Furthermore, I will try to outline an adjustment of the criminal law concerning the unauthorized business. At the end of my work I will propose some moves for limiting the unauthorized business. In my work I deal with the unauthorized business both from the theoretical point of view (the description of laws adjusting it) and from the practical point of view (the description of cases from the real life and the comparison of statistics). In the first chapter I define business, unauthorized business in terms of trade and criminal law and also the possible causes of the unauthorized business. In the second chapter I am concerned with the consequences of the unauthorized business and I evaluate damages caused by the economic criminal activity and by the unauthorized business. In the third chapter I carry out an analysis of the unauthorized business in terms of criminal law and both its previous adjustment § 118 of criminal law from the year 1961 and its new adjustment § 251 of the criminal code from the year 2009. Then I mention court and police statistics of the proven cases of unauthorized business. In the last chapter I deal with the possible preventive steps for the restriction of the unauthorized business.
