Působnost obce na úseku předškolního a základního vzdělávání

Abstract

Pokud má škola plnit svoji funkci a obec naplňovat roli zřizovatele, pak by vztahy mezi nimi měly být co nejlepší. Bohužel ne všude to tak funguje a v některých obcích škola se svým zřizovatelem spíše soupeří. Dovolím si tvrdit, že většina lidí nemá vůbec představu o tom, jak to ve vztahu škola - zřizovatel funguje, proto si kladu za cíl touto prací danou problematiku objasnit. V práci je použita metoda indukce, která spočívá v postupu od konkrétního, daného k abstraktnímu, zobecňujícímu, nebo také jinak řečeno je to přechod od jednotlivých faktů k obecným tvrzením. Proto tedy na základě daných legislativních zákonitostí a jednotlivých faktů o vztahu škola – zřizovatel zobecním tuto problematiku a nastíním jejich fungování v praxi. Nejprve se na obecné úrovni zabývám právním postavením a charakteristikou obce jako územního samosprávného celku, poté se zaměřuji na působnost obce na úseku předškolního a základního vzdělávání a nakonec se věnuji obci Dlouhá Loučka jako zřizovateli mateřské a základní školy. Na závěr jsem podala obecný přehled o tom, jak by tedy měl takový vztah škola – zřizovatel fungovat v pozitivním slova smyslu a jak to funguje i v opačném případě. Práce by mohla posloužit jako návod nebo příručka lidem, kteří se v této oblasti angažují, určují a rozhodují o záležitostech ve vztahu zřizovatel – škola, aby si uvědomili dané souvislosti.

If the school has to play its function and the municipality fulfills its role as the founder, then the relationship between them should be the best. Unfortunately, not everywhere this relationship works well thus in some communities the school rather competes with its founder. Let me state my opinion - most people have no idea about how the relationship school-founder works, therefore the aim of this thesis is to clarify this issue. In this thesis the method of induction is used meaning process from concrete to the abstract, in other words it is the transition from individual facts to general claims. Therefore, on the basis of the legislative principles and facts about the relationship of school - founder I generalize this problem and outline their functioning in practice. First, I generally deal with legal status of the municipality and its characteristics as a local government body, then I focus on the competence of a municipality in the area of preschool and primary education, and finally I consider the particular municipality Dlouhá Loučka as the founder of nursery and primary schools. At the end, I provide with a general overview of how the relationship school-founder should function in a positive meaning and how it works otherwise. The thesis could serve as a guide or manual for people working and making decisions in this field.
