Vymezení soutěžního práva a analýza činností Úřadu pro ochranu hospodářské soutěže v dané oblasti

Abstract

Cílem bakalářské práce bylo provést analýzu vybraných rozhodnutí a sankcí, které byly ÚOHS uloženy. V teoretické části práce bylo nejprve obecně popsáno soutěžní právo, jeho historie a vývoj, následně byla zaměřena pozornost na hospodářskou soutěž, objasněny pojmy s ní související, jako soutěžitel a relevantní trh, a blíže popsány jednotlivé formy hospodářské soutěže. Další kapitola je věnována již samotnému Úřadu pro ochranu hospodářské soutěže. Jsou zde blíže specifikovány jeho kompetence, pravomoci a povinnosti. V praktické části práce byla provedena zmiňovaná analýza rozhodnutí a sankcí. K provedení analýzy bylo stanoveno desetileté zkoumané období, tedy období let 2002 – 2011. V tomto období byly nejprve zkoumány počty zahájených správních řízení a počty pravomocných rozhodnutí z každé oblasti hospodářské soutěže v jednotlivých letech. Následně byly uvedeny významné případy řešené v posledních letech ÚOHS. V rámci analýzy sankcí byly zkoumány nejvyšší sankce uložené ÚOHS, následně byla provedena analýza sankcí v hodnotě nad 50 mil. Kč, kde bylo mimo jiné zkoumáno, které z nich nabyly právní moci, a které nakonec byly soudy zrušeny. Nakonec došlo k celkovému zhodnocení činnosti ÚOHS pro oblast hospodářské soutěže a byly navrženy určité změny.

The aim of this thesis was to analyze selected decisions and sanctions that were imposed on the Office for the Protection of Competition. In the theoretical part of this thesis a competition law, its history and development was described, then attention on the competition was paid on as well as the terms connected to it were explained and particular forms of competition were described. The next chapter deals with the Office for the Protection of Competition itself. Its competences, authority and duties are specified in detail. In the practical part of the thesis an analysis of decisions and sanctions was provided. Ten years period has been analyzed from 2002 to 2011. First of all the numbers of administrative proceedings and the number of effective decisions done out of each competition field by individual years were examined. Further, the significant cases having been dealt with by the Office for the Protection of Competition in recent years were stated. When analyzed the sanctions the highest sanctions imposed by OPC were examined as well as sanctions above 50 mil Czech Crowns including those, which came into force and which have been avoided by the courts. At the end total evaluation of the Office for the Protection of Competition was provided and some changes were recommended.
