Novela loterijního zákona, její klady, zápory a dopad na herní průmysl

Abstract

Cílem bakalářské práce je popsat a porozumět všem etapám vývoje právní úpravy provozování loterií a hazardních her. Časový rozsah byl zvolen od nejstarších historických zmínek o prvních loteriích až po dnešní dynamicky se rozvíjející herní průmysl. Právní úpravu herní problematiky v České republice platnou od 1. 1. 2012, kterou je novela zákona č. 202/1990 Sb., o loteriích a jiných podobných hrách v platném znění č. 458/2011, jsme podrobili důkladné analýze. Snažili jsme se vyhledat jak základní chyby, které se v nově vzniklé právní úpravě vyskytují, tak důležitá pozitiva, která přináší. Herní průmysl je totiž odvětvím, ve kterém se točí miliardy korun ročně a kvalitní právní úprava v našem právním řádu dosud chyběla. Rovněž jsme se pokusili upozornit na rizika, která tato novela zákona přináší České republice v rámci Evropské unie. Část práce jsme věnovali také dopadu novely loterního zákona na podnikatelské subjekty v oblasti herního průmyslu. Bakalářská práce je určena všem, kteří se o problematiku právní úpravy herního průmyslu zajímají, případně se jich přímo dotýká a rádi by se zorientovali ve spletitém a těžko srozumitelném výkladu zákona.

The aim of this work is to describe and understand all the stages of development lottery legislation to operation of lotteries and of gambling. The time range was chosen from the earliest historical references to the first lottery to today's dynamically evolving game industry. The law on gaming issues in the Czech Republic in force from January 1, 2012, which is the amendment of Act No. 202/1990 Coll. On lotteries and similar games as amended by No. 458/2011, were subjected to thorough analysis. We tried to find how the fundamental errors in the newly created legislation, so the important benefits that brings. The game industry has turnover in the billions crowns a year, and the quality of legislation in our legal order has lacked. We also tried to draw attention to the risks, which this Act brings for Czech Republic within the framework of the European Union. Part of the work are devoted of the impact of the amendment in the lottery legislation into the game industry. The thesis is intended for all who are interested in the issues of legislation of game industry or who is directly affected by this and who would like to better orient in a convoluted and difficult understanding of the interpretation of this amendment.
