Možná řešení nepříznivých důsledků hospodaření právnických osob

Abstract

Cílem bakalářské práce je popsat a následně zhodnotit jednotlivé způsoby řešení nepříznivé situace podniku a analyzovat, v jaké míře je podniky v České republice využívají, od zavedení insolvenčního zákona do současnosti. V práci jsou popsány pojmy insolvenčního zákona, od průběhu insolvenčního řízení po charakterizování jednotlivých způsobů, kterými podniky mohou řešit úpadek nebo hrozící úpadek. Konkrétně se jedná o konkurz a reorganizaci. Oba způsoby jsem hodnotila a analyzovala jejich využití v praxi. V práci je také popsána likvidace podniku, což je způsob, kterým nemusí být řešena jen tíživá situace podniku, ale tuto cestu může zvolit i provozuschopný podnik, který se rozhodl ukončit činnost. Bakalářská práce je podkladem pro orientaci v úpadkovém právu pro právnické osoby.

The aim of this bachelor thesis is to describe and evaluate different methods used to deal with an adverse situation of a company and to analyze the use of these methods in the Czech Republic since the introduction of the insolvency law until the present day. In this thesis, concepts of the insolvency law are described; from the process of insolvency proceedings to the characteristics of methods used to solve insolvency or threatening insolvency of a company. Specifically, these methods described are bankruptcy and reorganization. Application of both methods in practice is evaluated and analyzed. Liquidation of a company is described in this thesis as well; a method that can be applied to a company in an adverse situation as well as to a healthy company that is supposed to go out of business. This thesis can be used by legal personalities for orientation in the insolvency law.
