Kontrolní činnost na úseku živnostenského podnikání

Abstract

Práce se zabývá oblastí kontroly při výkonu podnikatelské činnosti s živnostenským oprávněním, které je u nás řazeno k nejrozšířenějším formám podnikání. Zajištění kontroly na tomto úseku podnikání je nezbytné pro usměrňování při dodržování povinností vyplývajících z právních předpisů, které upravují oblast živnostenského podnikání. Cílem práce je tedy přiblížení oblasti kontroly na úseku živnostenského podnikání, rozbor právních předpisů týkající se této oblasti a vytvoření uceleného přehledu o problematice výkonu živnostenské kontroly. V první části jsou vymezeny pojmy, které se vztahují k oblasti živnostenského podnikání a živnostenské kontroly. Následně jsou přiblíženy práva a povinnosti jak kontrolních orgánů, tak i kontrolovaných subjektů. Podstatná část práce je pak zaměřena na celý proces kontroly od jejího zahájení přes vlastní průběh až po ukončení včetně oblasti uplatňování postihů na úseku živnostenského podnikání, jakožto důsledku kontrolních zjištění, kde jsou popsány jak přestupky, správní delikty, tak i jednotlivé druhy sankcí.

This Bachelor Thesis deals with monitoring and supervision over the activities of licenced businesses which are considered to be one of the most common trade forms in the Czech Republic. Ensuring of supervision and control in this business area is imperative for the compliance with the obligations arising from the laws governing these commercial activities. The objective of the thesis is to approach the questions of control of the commercial activities, the analysis of the legislation in this field and to give a comprehensive overview of the supervisory issues over the business activities. The first section lists the professional terms related to the field of business and trade control. This part subsequently includes the description of the rights and obligations of both the supervisory bodies and the controlled entities. A substantial part of the work is focused on the control process from its start throughout its own course to the very end, including the application of sanctions in the sphere of commercial activities as a result of the inspection findings. This part also gives the description of offences and administrative delicts as well as various kinds of individual sanctions.
