Nekalá soutěž

Abstract

Práce na téma nekalá soutěž je rozdělena do tří hlavních kapitol. Nejprve se věnuji právnímu a ekonomickému pojetí nekalé soutěže. Je zde vysvětlen pojem nekalé soutěže dle obchodního zákoníku, prostředky ochrany proti nekalé soutěži a právní postih nekalé soutěže podle trestního zákona a také podle nového trestního zákoníku účinného od 1. 1. 2010. Dále jsou vymezeny příčiny a důsledky pro ekonomii a pro subjekty dotčené nekalou soutěží. Poslední část je věnována dvěma případům z praxe, které jsou rozebrány z právního hlediska a jsou zde doporučena opatření a řešení nastalých situací. Nakonec jsem zhodnotila současnou legislativu týkající se nekalé soutěže z vlastního pohledu. Cílem práce je poukázat na to, zda jsou právní předpisy týkající se nekalé soutěže postačující a zda jsou dostatečně využívány.

The work subject unfair competition is divided in three main chapters. At first I go in for the legal and economic meaning of the unfair competition. The concept of the unfair competition is there explained according to the Commercial Code, the instruments of protection against the unfair competition are explained according to the Criminal Code and also according to the new Criminal Code, which is effective since the January the 1st 2010. Further the causes and the consequences for the economy and for the subjects affected by the unfair competition are defined. The last part of the work is dedicated to two cases from practice, which are analyzed from the legal point of view and the measures and solutions for the arisen situations are recommended. Finally I assessed from my own view the present legislation relating the unfair competition. The objective of the work is to point out whether the legal regulations relating the unfair competition are sufficient and whether they are adequately used.
