Oddlužení se zaměřením na ekonomickou situaci dlužníků a rezervy současné právní úpravy

Abstract

V první části je uvedena současná právní úprava a způsoby, jakými je možno řešit dlužníkův úpadek. V druhé části je analyzována ekonomická situace dlužníků. První dlužník je modelovým příkladem podle statistických údajů. Následuje případ zaměstnaného muže, dvou manželů ve starobním důchodu a nezaměstnaného muže. Ve třetí části jsou uvedeny obdobné příklady ze dvou oblastí - rozhodování o snížení hodnoty splátek a povolení splácet v oddlužení za pomoci třetích osob, přičemž rozhodnutí soudů nejsou jednotná. Závěrem jsou navrhnuta doporučení ke sjednocení rozhodování.

In the first part there is the current legislation and the possibilities how to solve the debtor's bankruptcy. The second part analyzes the economic situation of debtors. The first borrower is a model example of the statistical data. The following cases are employed men, married retired couple and unemployed men. The third section provides similar examples from two areas - deciding about reducing of the value of the payments and the permission to repay the debt in the debt relief with the help of third parties where court decisions are not united. Finally there are proposed recommendations to unify decision-making.
