To business contractual relationship we should approach very attentively. Properly proven and secured claim is also better enforceable. If the creditor secures his claims he also prevents the situation where the run and progress of his company could be put at risk due to insufficient of his own financial resources.

The main goal of this thesis is an analysis of posibillities how to effectively prevent defaults and how to be protected against that. On the basis of materials I wanted to make a compact view of present legal regulations' situation in a department of a contractual relationships, culpability of entrepreneurial subjects' dealings and propose solutions to improve the creditor's situation and how.

This dissertation subject defaults is devided in tree main chapters. At first I'm trying to descibe liabilities and contractual relationship. In the next chapter I'm concerned about liability resourcing and I'm trying to analyse the consequences of defaulter and creditor due to their defaults. Next chapter is about default causes and consequences. In this chapter I was also concerned with property torts circumstances improving the creditor's situation.
