Abstract

The aim of this thesis is to describe the most fundamental risks, which the debtor can face during the process of insolvency and give an advice how he can prevent or eliminate them. The theoretical part is divided into two parts. The first one deals with a development of bankruptcy law before 1989 following by legal regulation being after this year more than necessary. By legal regulation bankruptcy and settlement is meant being replaced by bankruptcy act later on and this act is of effect now. The second part of theoretical part is focused on the explanation of basic terms used in this field. The whole process of insolvency proceedings with all important subjects and institutions being involved in this issue is also described here. The practical part is focused on the most fundamental risks the debtor can face. By those risks debtor´s liability for early submission of insolvency process, submission of unentitled motions to the debtor and limitation of treatment with debtor´s property are meant. By each risk the instruction how these risks can be prevented or eliminated is stated.
