Abstract

The goal of diploma thesis is an analysis of the obligation to pay for goods under an international contract of sale within the United Nations Convention on Contracts for the International Sale of Goods. Analysis of the contractual formulation of obligation to pay, as well as coherence of payment clause in relation to other provisions of the purchase contract. The practical part deals with the use of acquired and analyzed knowledge on the company ISMM Production & Business Cooperation s.r.o. In consideration of the export marketing, whitch has the lion’s share in business strategy of this company based on straight business cooperation with a wide range of companies in the European Union, the goal of the practical part is to reconnoitre the practical use of payment instruments in the company, the final comparison in terms of advantages, disadvantages, efficiency of use. For elaboration of this thesis was used the method of analysis, by analyzing the obligation to pay for goods under the CISG, payment terms as well as its projection to the payment of the contract. Through the methods of synthesis are summarized findings that were identified in the theoretical part. Using the methods of inference are moving from a general analysis of the various payment instrument, economic and legal analysis of the payment instruments in the practical use in an environment of ISMM Production & Business Cooperation.
