Abstract
The purpose of this work is, among other things, to assess the effect of deep mining on property rights registered in the real estate cadastre, and above all the impact on the right of ownership, encumbrance and lien rights, including the effect on the status of registration in the real estate cadastre in the areas affected by deep mining. The work also deals with the possibilities of correcting the cadastral map in the cadastral territories affected by deep mining, it evaluates the individual existing possibilities of correction, i.e. new mapping, renewal or revision of the cadastre. The mapping procedure in neighboring Germany is also partially mentioned here, as well as the system for determining compensation for damage caused by underground mining activities in Poland. The aim of this dissertation is also to achieve the amendment of Decree No. 357/2013 Coll., the cadastral decree, specifically its § 95, which actually succeeded during the creation of this thesis. Thanks to this amendment, the way has been opened for the correction of the cadastral map in the form of cadastral revisions, where control points will be targeted beyond the normal framework and then transformed. The result of this work is therefore the finding of a usable method for correcting cadastral maps in areas affected by deep mining, to which the achievement of the above-mentioned amendment of § 95 of the cadastral decree contributes very significantly. This work is mainly empirical in nature, based on the acquisition of real data, measurements in the field, real implementation of calculations and transformations, with the aim of achieving a result applicable in the practice of cadastral offices.
