Zajišťovací instituty v právu a jejich využitelnost v praxi z pohledu práva a ekonomie

Abstract

The aim of this thesis is to determine and evaluate important changes in legislation of securing institutions meant in new Civil Code by comparing new and previous legal regulation. The first part of the thesis outlines significance of securing, tis function and fundamental changes as for new terminology. Further, there is attention paid to individual securing institutions with stress on concrete changes being impacted by new Civil Code.

The conclusion of this thesis discusses applicability of selected securing institutes evaluated by chosen criteria of possible consequences of wrong choices and the possibilities of their solution.
