Abstract
The aim of my diploma thesis is to compare the implementation of Environmental Liability Directive 2004/35/EC and Council Directive 96/82/EC on the control of major-accident hazards involving dangerous substances into the legislations of Czech and Slovak Republic in order to find out differences, positive and negative facts. Next purpose is to analyze actual market with insurance of liability for damage as a consequence of major accident in Czech and Slovak Republic. The main indicators are number of plants, value of indemnity limit and value of retention.
Theoretical part of my diploma thesis (second part) contains description of basic rules, ideas and definitions important for well-understanding of the topic.
Third part is about implementation of Environmental Liability Directive into legislation of Czech and Slovak republic with concentration on law number 167/2008 Sb. in Czech Republic, in Slovak Republic number 359/2007 Z.z., on the ecological damage prevention and reparation. The chapter also speaks about comparison of law in both countries on control of major-accident hazards involving dangerous substances (law number 261/2002 Z.z. in Slovakia, in Czech Republic number 59/2006 Sb.).
The chapter four contains comparison of the major-accident hazards insurance market in both countries concentrated on a number of insurance companies, number of plants included in discussed law and values of indemnity limit and retention. Situation in Czech Republic is analyzed in a period between 2003 and 2010. In Slovak Republic is analyzed mainly actual situation. Fourth part also contains description of three major-accidents that happened in Slovakia in U.S. Steel Košice s.r.o. and Novácké chemické závody in Nováky.
