Abstract

The subject of the thesis is “Public-law Contracts and Problems of Disputes resulting from Them”. Public-law contract is a bilateral or multilateral legal operation, which establishes changes or repeals rights and duties in public law. Force and authority of public law subjects or self-government are transferred through the public-law contracts. The thesis is divided into three parts. In the first part, conception and function of the public-law contracts and situation of the public-law contracts in our legal order are qualified. The second part is focused on material-law and procedural-law regulations of the public-law contracts. Within the scope of the material-law regulation, the public-law contracts in this Bachelor thesis were divided into coordination contracts, subordination contracts and contracts between contracting parties, in the next section particular contracts were enlarged.The procedural-law regulation deals with conclusion, modification and discharge of the public-law contracts, with conformity with legal regulations and with approval of third parties.The final section of this Bachelor thesis involves settlement of disputes resulting from the public-law contracts. The aim of the Bachelor thesis is to provide the readers with integrated and general insight into the public-law contracts the regulations of which are based not only on the Administrative Procedure Code but also on the particular special legislation.
