Abstract

The current economic recession threatens state bankruptcies and leaves behind a failing businesses.In the market and the public environment is the demise of the body always associated with negative economic and social consequences, which, in the present world will never be in the range of a regional dimension, although it may appear. For these reasons, the thesis deals with the very current issue, and that the solution to the bankruptcy of legal persons, in the context of the insolvency proceedings, when the thesis is described in the legislation governing the decay of a legal person, the ways to address the decline of the legal persons and the differences between the ways to address the decline of both creditor and debtor. It is also in the work carried out economic assessment of the various forms of the borrower's bankruptcy in terms of satisfaction of the creditors.
