Abstract

Eleven years ago due to the planned entrance of the Czech Republic to the EU was introduced to the Czech legal system an Institution authorised to solve disputes among costumers and their financial service providers out of court. This Institution is called the Financial Arbiter. The Arbiter proceedings belong to alternative disputes resolution schemes using in Member States of EU. The scheme is called as quasi-arbitration. There are some specifications in this type of ADR scheme like the institute is authorised to issue legal binding decisions. Nevertheless such decisions may be brought to the Court. The goal of this diploma thesis is to assess existing activities of the financial arbiter in the Czech Republic since 2003 and to point on some deficiencies in the legislation of such institution.
