Abstract

The master thesis called Personal Bankruptcy and its Impacts on the Debtor in Comparison with Federal Republic of Germany is divided into five parts. The main purpose of the thesis is to provide an overview of debt relief proceedings for people in the Czech Republic who are going bankrupt as well as for those who are interested to file a Debtor´s Bankruptcy Petition. Considering the particular insolvency proceedings the whole debt relief proceedings is in comparison with Federal Republic of Germany. The second chapter is theoretical and methodological part. It deals with characteristic of personal bankruptcy in the Czech Republic in comparison with legal regulation of personal bankruptcy in Federal Republic of Germany. The third chapter contains a process of debt relief shown in both of the countries. It explains also possible causes and impacts of debt relief on the debtor. The last chapter is application and verification part. This part demonstrated a real insolvency proceedings number KSOS 33 INS 17514/2014, i.e. analysis of particular steps during insolvency proceedings, determination of center of main interests and comparison of plans for creditors satisfaction in the Czech Republic and Federal Republic of Germany. In the text of master thesis there are used methods of description, observation, analysis and comparison.
