Možnosti vymáhání dluhů fyzických osob v České republice

Abstract

This thesis deals with the recovery of debts of natural persons in the Czech Republic. The main objective was to determine which of the debt recovery options is the most advantageous for creditors from the financial and time point of view. The theoretical part of this thesis defines the different options that a creditor can use in case their debt is overdue and they still have not received payment. These options are out-of-court and judicial debt recovery. The various methods of debt recovery are described in the theoretical part, indicating the financial and time burden on the creditor. Given that the theoretical level of the issue was defined, the method of description was used in this part of the thesis. The practical part is divided into two chapters. The first chapter of the practical part deals with the comparison of enforcement and insolvency proceedings. For this purpose, the methods of observation and comparison were used. The comparison was made on the basis of two archival files provided by a selected law firm. In order to summarise the findings of this chapter, a SWOT analysis was carried out at the end. The second chapter of the practical part focused on the application of debt recovery options in practice through the method of statistical analysis of a sample. The sample consists of randomly selected set of 100 files dealing with debt recovery of entrepreneurial individuals. A sub-objective of this chapter was to determine the most common method of debt recovery. The main objective was achieved in this chapter by determining the method of debt recovery that is the most advantageous to the creditor in the required aspects.
