Abstract

This master thesis deals with the topic of insurance frauds in the Czech republic and Germany. The objective of this thesis is to evaluate the process of exposing and solving of insurance frauds, and the procedure of settlement of insurance claims in the Czech republic and Germany, as well as to propose possible resolutions based on available information. The first two chapters of the thesis deal with the basic characteristics and legal regulations of insurance fraud in the Czech republic and Germany. The focus will be on the legal regulations of the insurance contract, the rights and duties arising from the insurance contract, and insurance fraud from the view of the criminal law. The third chapter concentrates on revealing and resolving insurance frauds, deals with instruments of insurance fraud prevention and systems, and also describes the procedure of settlement of insurance claims in the Czech republic and Germany. The last chapter evaluates the process of resolution and exposition of insurance frauds and and contains propositions to improve current system, based on available information.
