Abstract
This bachelor’s thesis examines the issue of unauthorized business activities from the perspective of the Czech legal system and their economic impact on the market environment. The main objective of the thesis is to analyze the current legal framework, define the differences between administrative and criminal liability, and assess the impact of the shadow economy on the state budget. The theoretical section defines the fundamental characteristics of business and the conditions for its lawful conduct, emphasizing the distinction between lawful activity and unauthorized interference in regulated sectors. The practical section is based on an analysis of the case law of the Supreme Court and the Supreme Administrative Court, as well as an evaluation of statistical data for the period 2021–2025. Particular attention is paid to digital platforms and the sharing economy, which present new challenges for regulatory authorities. The conclusion of the thesis outlines proposals for making enforcement measures more effective and improving prevention efforts in the area of illegal business activities.
