Pojistné a dotační podvody při podnikání v ČR a jejich právní kvalifikace.

Abstract

Cílem diplomové práce je analýza skutkových podstat pojistných a dotačních podvodů v ČR. V teoretické části práce jsou popsány skutkové podstaty pro trestný čin páchání pojistných a dotačních podvodů, příčiny konání tohoto trestného činu a ekonomické dopady. Metodou komparace je především srovnán rozdíl mezi dopady pojistných a dotačních podvodů a úspěšností řešení. Jedním z kritérií analýzy je četnost výskytu těchto trestných činností a právní kvalifikace podvodů. V praktické části jsou zmíněny návrhy možné prevence pro snížení výskytu zmíněných protiprávních jednání. Diplomová práce popisuje vývoj pojistných a dotačních podvodů v českém trestním řádu s návrhy možného znění.

The aim of this work is analysis of the facts “insurance and endowment” frauds in historical progress in the country of Czech Republic. The theoretical part describes the subject of matters both of frauds, the causes of crime, economical consequences and real progress till present. The method of comparison is primarily compared the difference in subject of matters between insurance and endowment frauds. One of the criteria above analysis is the historical numbers of accused and the introduction of the historical facts of the issue. In the practical part of the proposals are discussions, possible and suggested solutions for decreasing amount of frauds in the Czech Republic. Dissertation thesis describes the development of the institutes of insurance and endowment in the Czech Criminal Procedure, with possible suggestions.
