Abstract

The aim of bachelor thesis is to provide essential information or overview about liability and lien by the current law and subsequently about their common utilization in practice from the perspective of the particular company. In the theoretical part is first explained general meaning of securing the obligations of the debtor to the creditor, as well as the importance of legislation. Then here are the basic date of two significant securing institutes which are liability and lien. The liability is compared mainly in terms of its different modifications in the Civil and the Commercial Code. Except of the subject of pledge as part of lien here are the ways of realization of a lien too including its types. As part of both securing institutes there are mentioned basic rights and obligations of subjects, as well as the ways of creation even termination of the instrument. In practical part there are liability and lien described in terms of their utilization within a particular company. Here are mentioned mainly conditions of provision of loan secured by liability or lien including the amount of the loan.
