Význam a ochrana práv duševního vlastnictví v kontextu mezinárodně obchodních vztahů

Abstract

The objective of the thesis lies in comparison of the current state of intellectual property rights and their protection in the different concepts of international organizations and major economic centers, and research of the effectiveness of measures to protect intellectual property rights. The thesis draws from key international agreements under the WTO and WIPO. The thesis highlights the potential recovery of claims resulting from intellectual property rights violation, which is made possible by the TRIPS Agreement existence. There is also demonstrated the function of the system of intellectual property in developed economies in the text of the thesis, using the U.S. example. It explains the process of creating a national intellectual property strategy as well, according to Japanese alternatives. The Thesis also describes the process of implementation of EU rules into law and practice of Member States that it is demonstrated on the Czech situation. This thesis gives a comprehensive view of the state of IPR in international trade relations and comparison of fundamental approaches in the concept of IPR protection and its practical impact in the economic rights, legal and social spheres.
