Abstract

The aim of my diploma work is to define the unauthorized business and its economic and legal causes and to describe consequences of the unauthorized business. Furthermore, I will try to outline an adjustment of the criminal law concerning the unauthorized business. At the end of my work I will propose some moves for limiting the unauthorized business. In my work I deal with the unauthorized business both from the theoretical point of view (the description of laws adjusting it) and from the practical point of view (the description of cases from the real life and the comparison of statistics). In the first chapter I define business, unauthorized business in terms of trade and criminal law and also the possible causes of the unauthorized business. In the second chapter I am concerned with the consequences of the unauthorized business and I evaluate damages caused by the economic criminal activity and by the unauthorized business. In the third chapter I carry out an analysis of the unauthorized business in terms of criminal law and both its previous adjustment § 118 of criminal law from the year 1961 and its new adjustment § 251 of the criminal code from the year 2009. Then I mention court and police statistics of the proven cases of unauthorized business. In the last chapter I deal with the possible preventive steps for the restriction of the unauthorized business.
