Ekonomické a právní dopady selftradingu v ČR

Abstract

Cílem bakalářské práce je analýza skutkové podstaty selftradingu s historickým vývojem v ČR. V teoretické části práce jsou popsány skutkové podstaty pro trestný čin zneužívání postavení v obchodním styku, příčiny konání tohoto trestného činu a samotný vývoj od roku 1991 po současnost. Metodou komparace je především srovnán rozdíl ve znění mezi Českou a Slovenskou republikou. Jedním z kritérií analýzy je výše počtu obžalovaných za rok 1999 až 2008 a historická problematika zavedení skutkové podstaty. V praktické části jsou zmíněny návrhy odborné veřejnosti na možné znění a navrženo možné řešení pro ČR. Bakalářská práce popisuje vývoj institutu selftrading v českém trestním řádu s návrhy možného znění.

The aim of this work is analysis of the facts “selftrading” with historical progress in the country of Czech Republic. The theoretical part describes the subject of matters of a criminal offence is the abuse in business trade, the causes of crime and real progress since 1991 to present. The method of comparison is primarily compared the difference in subject of matters between the Czech and Slovak Republic. One of the criteria above analysis is the number of accused per year from 1999 to 2008 and the introduction of the historical facts of the issue. In the practical part of the proposals are discussions, in the professional community, possible and suggested solutions for the country. Bachelor thesis describes the development of the institute selftrading in the Czech Criminal Procedure, with possible suggestions.
