Neoprávnené podnikanie a možnosti jeho obmedzovania

Abstract

Cieľom diplomovej práce je analýza súčasného stavu neoprávneného prevádzkovania podnikateľskej činnosti zameraná na identifikáciu možností eliminácie tohto javu v spoločnosti a návrh riešenia situácie rozšíreného výskytu neoprávneného podnikania na území Českej republiky. V teoretickej časti sú vymedzené jednotlivé pojmy neoddeliteľne sa spájajúce s danou témou. Neoprávnené podnikanie je následne charakterizované a pomerne podrobne sú analyzované príčiny podmieňujúce jeho vznik. V praktickej časti tejto práce sú uvedené viaceré návrhy riešení na elimináciu neoprávneného podnikania v krajine. Práca metódou analýzy definuje postupy štátnych orgánov pri zamedzovaní neoprávnenému podnikaniu, prijímaní nových právnych predpisov a uplatňovaní sankcií. V praktickej časti sú využité aj štatistické údaje, pomocou ktorých je metódou komparácie porovnávané sankciovanie neoprávneného podnikania v posledných rokoch. V závere práce je využitá metóda deskripcie na špecifikovanie cieľov a odporučenie opatrení, ktoré prispejú k zníženiu výskytu neoprávneného podnikania v krajine.

The goal of the diploma thesis is to analyze current situation in the illegal operation of business activities focused on identifying ways of elimination of the phenomenon in society and proposing a solution to widespread occurrence of illegal enterprise in the Czech Republic. Theoretical section consists of definitions of terms related to the topic of this work. Illegal enterprise is defined and there is a considerable detail in the outline showing different causes of its origin. The practical part of work introduces several proposals and solutions to eliminate illegal enterprise in the country. The thesis uses method of analysis to define the procedures of state authorities in preventing illegal enterprise, adopting new legislation and application of the penalties. In the practical part are also used statistical data by which setting of penalties to unauthorized business in recent years are compared. In conclusion the method of description is used to specify the objectives and recommended actions to help prevent unauthorized business in the country.
