Vyhodnocení smluvní úpravy na úrovni obchodu mezi EU a Kanadou

Abstract

Diplomová práce je zaměřena na rámcovou smluvní úpravy CETA, jinými slovy obchodní dohodu uzavřenou mezi EU a Kanadou. Cílem této diplomové práce je analýza této samotné rámcové smluvní úpravy a hodnocení jejich samotných dopadů pomocí analýzy obchodní bilance ve vytyčených letech a komparace netarifních překážek obchodu v rámci smluvní úpravy CETA vůči WTO. Teoretická část diplomové práce obsahuje základní vymezení zúčastněných stran ve smyslu možností uzavírat obchodní dohody. Jsou zde rozebrány obchodní vazby a formy vzájemné spolupráce mezi oběma stranami. Dále je zde rozepsána podstata fungování organizace WTO a jsou zde také vymezeny konkrétní netarifní překážky obchodu pro komparaci mezi dvěma celky nezbytné. V praktické části diplomové práce je provedena analýza obchodní bilance mezi Českou republikou a Kanadou ve dvou sledovaných obdobích, a to před a po podepsáním rámcové smluvní úpravy CETA. Následné hodnocení těchto sledovaných období je podloženo strukturou nejobchodovanějších komodit mezi ČR a Kanadou. Dále je zde provedena komparace uvedených netarifních překážek obchodu v rámci CETA vůči WTO a následné uvedení konkrétních sektorů, jímž nese právní úprava regionální dohody CETA vůči základní právní úpravě v rámci WTO patřičné výhody.

The diploma thesis is focused on the framework contractual arrangements of CETA, specifically the trade agreement concluded between the EU and Canada. The aim of this diploma thesis is the analysis of agreement and the assessment of their impacts by means of an analysis of the trade balance in the specified years and a comparison of non-tariff barriers to trade within the scope of the CETA agreement within the WTO. The theoretical part of the thesis contains a basic definition of the parties involved in the sense of the possibility of concluding business agreements. Business ties and forms of cooperation between the two parties are analysed here. Furthermore, the essence of the functioning of the WTO organization is described here, and specific non-tariff barriers to trade necessary for comparison between the two entities are defined here. In the practical part of the thesis, an analysis of the trade balance between the Czech Republic and Canada is carried out in two observed periods, namely before and after the signing of the CETA framework agreement. The subsequent evaluation of these observed periods is supported by the structure of the trade of the most traded commodities between the Czech Republic and Canada. Furthermore, there is a comparison of the mentioned non-tariff barriers to trade within the framework of CETA with respect to the WTO and the subsequent presentation of specific sectors in which the legal regulation of the CETA regional agreement carries appropriate advantages compared to the basic legal regulation within the WTO.
