Abstract

The thesis deals with personal data protection in relation to employees as a subject of data. The aim of the thesis is to analyze regulation of personal data protection, also the paper elaborates on difficulties that could be caused by the processing of personal data of employee on the part of employer. At the beginning, general issues of personal data protection are analysed. The introductory part also includes an explanation of terminology and a description of individual rights and obligations in the field of personal data protection. In the following part the author concentrates on the regulation of disposal ofparticular types of personal data. Attention is devoted to the extent of personal data that the employer may request from candidates for a work, as well as to the necessity of the employee’s consent to the processing of their personal data by the employer. This section also discusses inclusion of certain pieces of information, such as information about a health conditions, criminal convictions or photos, into a sensible data category. The aim of the last chapter is to capture a range of possible examples of the processing of personal data, which can take place and actually does take place in labour law practice, in general. At the end of this thesis, some specific situations were chosen to demonstrate how company process personal data of their employees. Then the basic obligations of data processing are analyzed with respect to real situations.
