Vývoj trestné činnosti postihující oblast hornictví a rekultivací od roku 1990 do současnosti a její důsledky

Abstract

Kriminalita je obecně nebezpečným a zatěžujícím prvkem společnosti, která zasahuje do všech oblastí, bez rozdílu, zda se jedná o hospodářskou nebo majetkovou trestnou činnost. Její účinky zasahují také hornictví i rekultivace. Obzvláště nebezpečná je latentní hospodářská kriminalita, která vytváří základy pro tzv. šedou ekonomiku a současně pomáhá vzniku korupčního prostředí. Problematika kriminality, ohrožující zejména zmiňovanou oblast, není systematicky řešena, a způsobené problémy trestnou činností jsou projednávány až v případě jejího odhalení. Proto se diplomová práce snaží poukázat na jednotlivé druhy kriminality zatěžující oblast hornictví a rekultivací, ale také analyzovat současný stav i vývoj. Cílem práce bylo také poukázat na složitost celého procesu a navrhnout řešení, které pomůže významně omezit kriminalitu a pozitivně ovlivnit odhalování trestné činnosti.

Crime, either economic crime or crime against property, constitutes a burden and danger to the society. Even mining and recultivation are affected. Latent economic crime is particularly dangerous as it creates the base for so called grey economy and enables corruption. The issue of crime affecting the above mentioned areas has not been dealt with adequately. The problems which it causes are tried just in case it is revealed. Thus this thesis tries to show particular types of crime burdening the mining industry and recultivation. It also analyses the development of the crime and it´s present state. Another aim of the thesis is to point out how complicated the process is and suggest how the crime could be reduced dramatically and influence the methods of detecting the offences.
