Abstract
The purpose of this Master thesis is to present mediation as an Alternative Dispute Resolution in the Business - describe, compare, illustrate with an example the course of business mediation and assess the situation at the business units of Czech Republic.
The thesis is composed of the six chapters. The first chapter is introduction with described goals of the thesis. The second chapter presents the basic concept of business mediation, for example conflict, principles of mediation, the mediator’s responsibilities and techniques used in mediation. The next chapter of the thesis is describes how is mediation used in business contact in the European, Czech, Austrian, German and British legal environment. At the end of this chapter are compared legislative frameworks in each country and there are defined differences and similarities of mediation in trade in these particular countries. The fourth chapter describes the process of mediation from both theoretical and practical aspects, which is supplemented by important notes from the course. The fifth chapter is called mediation in numbers and includes economic analysis of the cost of mediation, a comparison of costs between mediation, arbitration and court in individual countries EU and research of mediation awareness at the business units in the Czech Republic. The last part is the conclusion that summarizes findings of this thesis.
