Hospodářská kriminalita v oblasti finančního leasingu a úvěru

Abstract

Tato práce teoreticky pojednává o pojmech finanční leasing a úvěr, objasňuje rozdíly mezi nimi, rozebírá podmínky jejich uzavírání a upozorňuje na možná rizika, ke kterým může dojít nesprávnou formulací smluv či záměrným zamlčováním či zkreslováním údajů potřebných k uzavření těchto typů smluv. V závěru uvádí právní postihy pro osoby, které se při jejich uzavírání dopouštějí trestných činů proti majetku uvedených v Páté hlavě Trestního zákoníku.

This dissertation theoretically deals with the issues of financial leasing and credit, it clears the differences between them, analyse the conditions of their concluding and points out possible hazards which can occur by the wrong formulation of contracts or by deliberative suppressing or falsifying information needed for concluding of contracts of these types. In the final part it mentions criminal sanctions for persons who, while concluding the contracts, commit crimes against property as shown in Catch V of the penal code.
