Novela insolvenčního zákona a její dopad na formy řešení úpadku z právního a ekonomického hlediska

Abstract

The subject of the thesis is the amendment of insolvency act and its impact on bankruptcy solving in the frame of legal and economic aspect. The thesis is divided into three chapters. The parts content characteristics of new terms in the field of insolvency, introduced by the amendment of Insolvency Act, the content of new legal regulation of the Insolvency Act with the grounds for its implementation and, finally, its evaluation and comparison with the situation prior to the amendment.

The first part deals with the characteristics of new terms in the field of insolvency. There is described the term of bankruptcy, along with other basic terms. Then the terms related with assets, insolvency administrators, creditors and claims in insolvency proceedings.

The second part outlines the content of the legislation and the reasons for its implementation. The chapter is divided according to type of bankruptcy resolution, which defines the Insolvency Act. Then there are the reasons for its implementation. In the last part there is new legal regulation evaluated in terms of various forms of bankruptcy solving.

The aim of this thesis is to describe the innovations introduced by the Insolvency Act, describe the reasons for its implementation, evaluate its amendment and compare existing legal regulation with the previous one in terms of various forms of bankruptcy solving.
