Návrh vyhlášky o starých důlních dílech

Abstract

V předložené práci je zpracována stručná historie horního práva na českém území a obecně popsán legislativní proces tvorby nové právní normy. Práce analyzuje současné horní právo z hlediska starých důlních děl. Výsledky analýzy jsou zahrnuty do konceptuálního podkladu návrhu nové vyhlášky nahrazující stávající vyhlášku Ministerstva životního prostředí České republiky č. 363/1992 Sb., o zjišťování starých důlních děl a vedení jejich registru. Mezi oblasti, které práce navrhuje prioritně řešit v nové vyhlášce, patří zejména definice pojmů, jednotná evidence důlních děl, určení vlastnických vztahů u starých důlních děl a převody starých důlních děl na nové provozovatele.

The submitted study presents a brief history of mining legislation in the Czech territory and a general description of the legislative process creating a new legal norm. The study provides an analysis of the current mining legislation from the viewpoint of old mine workings. Results of this analysis are incorporated into conceptual material for a novel regulation to substitute the present Decree of the Ministry of the Environment of the Czech Republic No. 363/1992 Coll. on detection of old mine workings and keeping a file on old mine workings. Areas herein proposed to be accentuated in the new regulation include definitions of terms, a universal record of mine workings, settlement of proprietary relationships of old mine workings, and transfers of old mine workings to their new operators.
