Význam ochrany průmyslových práv pro ekonomiku

Abstract

Bakalářská práce se zabývá problematikou porušování chráněného průmyslového vlastnictví a jeho vlivu na ekonomiku. Cílem práce je informovat o způsobech ochrany průmyslových práv, jejich důležitosti, možnostech při jejich vymáhání a prostřednictvím analýzy příčin a důsledků definovat některá stávající i teoreticky možná opatření, která by pomohla eliminovat jejich porušování. Teoretická část se zaměřuje na vysvětlení základní pojmů a detailní výklad způsobů ochrany průmyslového vlastnictví. Není také opomenut historický vývoj této právní oblasti na našem území a jeho význam pro ekonomiku. V praktické části jsou analyzovány příčiny a důsledky porušování průmyslových práv, které zahrnují nejen důsledky pro jejich majitele, spotřebitele nebo stát, ale i důsledky pro jejich porušovatele. Majitelé průmyslových práv mohou svá práva vymáhat prostředky soukromoprávními, veřejnoprávními a trestněprávními. V závěrečné části práce jsou diskutovány prostředky, které eliminují riziko porušování chráněných průmyslových práv. Jedná se především o aktivitu kontrolních orgánů, preventivní opatření majitelů průmyslových práv a možné legislativní úpravy inspirované právní úpravou jiných zemí. Z výsledků dotazníkového šetření vyplynulo, že jedním z prostředků snížení porušování průmyslových práv může být zvýšení informovanosti možných původců nových technických řešení o možnostech jejich ochrany. Zvýšení informovanosti o dopadu nákupu předmětů porušující průmyslová práva je rovněž doporučeno pro širokou veřejnost.

The bachelor thesis deals with a breach of industrial property rights’ protection and its impact on economy. The aim of the thesis is to inform about the ways of industrial property rights’ protection, its importance, and ways of execution. By an analysis of reasons and consequences, some current and theoretically possible measures, which could help to eliminate a breach of industrial property rights, are to be defined. Theoretical part of the thesis is focused on the basic terms explanation and detailed explanation of industrial property rights’ protection. Neither historical development of this field in our country and its impact on economy is avoided. In the practical part of the thesis, there are reasons and consequences of industrial rights breach analyzed involving not only rights owners but rights violators, consumers or state, too. Industrial rights owners can execute their rights by private, public or criminal law. In the last part, there are means eliminating a risk of the breach of industrial rights discussed such as activities of controlling authorities, preventive regulations and possible legislative adjustments inspired by the law of other countries are meant. The results of the questioning showed that one of means to lower the breach of industrial rights, an increase of awareness about the protection is. Such increase of awareness is also proposed for the wide public as it comes to impact of purchasing the subjects breaching the industrial rights.
