Trestní odpovědnost právnických osob a možnosti její prevence

Abstract

The bachelor thesis deals with a criminal liability of legal entities and the possibilities of their prevention. The aim of the work is focused mainly on the possibilities of prevention, thanks to which a legal entity has the opportunity to prevent the commitment of crime. The theoretical part deals with a definition of basic concepts such as legal entity or criminal liability. Furthermore, this part outlines the content and development of the Act on the criminal liability of legal entities and proceedings against them. Further, there are analyzed the effects of violations of the law from both a legal point of view, thus the penalties determined by the Act on Criminal Liability of Legal Entities, and a economic perception. In the practical part of the thesis, there are two practical cases analyzed, which were dealt with and decided by the Supreme Court. The first one deals with the connection of a crime to a legal person and the second one analyzes errors in the Compliance program usage. In the conclusion, there are the results of practical cases´ analysis summarized and the criminal liability of legal entities and the criminal liability of natural persons are compared. Based on the conclusions, there is a possible prevention of criminal liability of legal entities through the Compliance Program recommended.
