The name of bachelor thesis: Execution of non-monetary claims
Name of Student: Eva Cyroňová
The subject of the thesis is the Execution of non-monetary claims. The thesis is divided into four separate chapters. The first chapter explains the general concepts that are needed to understand the issue.
Following chapter deals with various ways of implementation of executions in the Czech Republic. Emphasis is placed on the characteristics satisfy the rights of non-cash charge / which includes clearing, removing things, sharing a common purpose, performance and power/.
In the third section is evaluated the current legal situation with the planned execution of amendments and analyzed statistical data. There is a comparison of successful enforcement of execution and pointed out some weaknesses in the current law legislation that will be removed by the new amendments, which is currently being discussed by Government of the CR.
The last chapter compares the execution in the Czech Republic and Slovak Republic.
The aim of my dissertation is to enforcement proceedings under the current regulation in force with the forthcoming amendment of the Regulations and the Enforcement of Civil Procedure, which is currently being discussed by government and also the analysis of non-monetary claims of enforcement proceedings in the Czech Republic and Slovak Republic in the framework of existing legislation.
