Abstract

As my diploma thesis I have chosen the theme Debt Relief of Natural Persons as a Possible Way of Solving the Debts from their Business. The aim of my diploma work is analyze current methods of remediation method of resolving insolvency and the very process of debt relief for individuals, which was obliged to meet its obligations arising from business activities. Analysis of the current procedure of the debtor in the process of deleveraging, status and response procedures creditors and insolvency courts. The theoretical part is focused on describing the insolvency proceedings, pointed primarily to the amendment to the Insolvency Act 2014 and 2016. The theory is focused on the process of debt relief, which is then approached in the practical part. The practical part analyzes the process of debt relief under examination and comparison of two individual debtors, who were chosen from a publicly accessible insolvency register on the website of the Czech Justice Ministry of Justice. Partial aim is to draft a procedure of the process of debt relief for individuals, which could become the subject of insolvency proceedings .. The practical outcome of this work is to propose recommendations and possible solutions to reconcile the terms of debt relief, the unification of the rules of procedure and conduct of the insolvency court and the obligations of the debtor in the process of deleveraging, based on research, observation and comparison between individual cases, which were previously dealt with in the Czech Republic.
