Nová úprava pojistné smlouvy a dopad její změny na praxi

Abstract

The aim of the thesis is to describe insurance contract in the frame of new Civil Code, point out the changes mainly those related to contracts conclusion, constitution and termination of insurance and further evaluate what impact those changes have on insurance contract conclusion. In theoretical part, there is historical development of insurance contract legislation as well as new adjustments in new Civil Code mentioned. This diploma thesis is divided into two practical parts. The first part deals with comparison of the previous and new Civil Code as it comes to insurance contracts. Further, the changes are analyzed. The second practical part mentions preparation for new legislation provided by Czech Insurance Association and the other insurance companies. Next part of the thesis analyzes what impact the changes in legislation have on new insurance contracts. The final part of the thesis also includes the rule of equal treatment. This diploma thesis can serve to all, who consider insurance contract conclusion.
