Způsob řešení úpadku společnosti konkurzem

Abstract

Smyslem této diplomové práce je zaměřit se na problematiku úpadku dlužníka a možné způsoby jeho řešení, s širším zaměřením na konkurz. Teoretická část diplomové práce objasňuje pojem úpadek, popisuje průběh insolvenčního řízení, činnost insolvenčního správce, postavení věřitelů v insolvenčním řízení a přihlašování jejich pohledávek, obsah majetkové podstaty, podávání insolvenčních návrhů a jednotlivé způsoby řešení úpadku dlužníka, kterými jsou konkurz, reorganizace a oddlužení. Další část je věnována průběhu konkurzu z pohledu věřitele a dlužníka, nepatrnému konkurzu, účetním a daňovým aspektům insolvenčního řízení a vývojem insolvence v Evropě a v České republice. Obsahem praktické části je projekt společnosti, která na sebe podala insolvenční návrh z důvodu platební neschopnosti. Úpadek společnosti je řešen formou konkurzu. V projektu je podrobně zpracován návrh na zahájení insolvenčního řízení, přihlášky pohledávek věřitelů, soupis majetkové podstaty, zpeněžování majetkové podstaty formou dražby a konečná zpráva, která podává celkovou charakteristiku činnosti insolvenčního správce, s vyčíslením finančních výsledků.

The purpose of this theses focus on the issues of the bankruptcy of the debtor and the possible ways to solve it, with a wider focus on liquidation proceeding. The theoretical part theses explains the concept of bankruptcy, insolvency proceedings, describes the progress of the activity of insolvency administrator, creditors in insolvency proceedings and their claims, the contents of the estate administration insolvent proposals and individual arrangements for dealing with the bankruptcy of the debtor, liquidation proceeding, reorganization and debt relief. The next part is devoted to the liquidation proceeding of the creditor and the debtor, the alleged liquidation proceeding, accounting and tax aspects of insolvency proceedings and the development of insolvency in Europe and in the Czech Republic. A practical part is the company that made the receiver of the proposal on top due to insolvency. Bankrupt company is solved by liquidation proceeding. The project is fully processed, a proposal to initiate insolvency proceedings, the claims of creditors of the estate, a stay of the estate by the auction and the final report, which makes the overall characteristics of the insolvency administrator, using quantified financial results.
